About the marital status of proteges in the clergy.
Our pious and Christ-loving emperor called upon this holy Ecumenical Council to make those who are in the clergy and teach others the divine, pure and immaculate servants, worthy of the mental sacrifice of the great God, who is both the Victim and the Bishop, and to cleanse them from the filth that has attached to them due to lawless marriages. To this, those belonging to the most holy Roman Church proposed to observe the rule of acrivia, and those subject to the throne of this God-protected and reigning city - the rule of philanthropy and compassion. Therefore, we, fatherly and together lovingly uniting both together, so as not to allow either relaxed meekness or cruel severity, and especially taking into account the fact that the fall that occurred through ignorance extends to a considerable number of husbands, we determine to subject to canonical eruption those who were involved in a second marriage and until the 15th day of last January of the month of the past 4th Indictment 6199 remained in enslavement sin, not wanting to come to their senses.
As for those presbyters or deacons who, although they fell into such a passion for second marriage, however, before we knew about it, they learned what was useful and cut off evil from themselves, throwing this alien and illegal relationship far away, as well as those whose wives of their second marriage had already died, and they themselves converted, having learned chastity and soon forgetting their former iniquities - about such it was decided that they should cease any kind of sacred service or action, from then on being under penance for a certain time. Let them enjoy the honor of the seat and the position they occupy, being content with the place of honor and crying before the Lord, so that He may forgive them their lawless act, committed out of ignorance. It is inappropriate for one who must care for his own wounds to bless another.
And those who, although married to one wife, but the one they took was a widow, as well as those who, after ordination, entered into an illegal marriage, that is, presbyters, deacons and subdeacons, after being removed from the priesthood for a certain short time and being under penance, can again be returned to their degrees, provided that they never advance to another, higher, degree and, of course, if they are already dissolved the unlawful cohabitation.
However, we have decreed this regarding those who, as stated, before the 15th day of the month of January of the 4th indictment were noticed in the above-mentioned sins, and only regarding sacred persons, from now on we define and renew the rule, which reads: “He who has been married in two marriages after baptism or who has taken a concubine cannot be a bishop, or a presbyter, or a deacon, or generally belong to the list of the sacred rank.” Likewise, “whoever takes as his wife a widow, or an abandoned woman, or a harlot, or a slave, or an actress cannot be a bishop, or a presbyter, or a deacon, or even belong to the list of the sacred order.”
