That the unknown absence of a husband does not give the wife the right to enter into a new marriage.
She who, after her husband has left and gone missing, cohabits with another until she receives news of her husband's death commits adultery. In the same way, the wives of warriors who married because it was not known where their husbands were are subject to the same determination as those who did not wait for the return of their absent husband. However, here this act has some excuse, because the assumption about the death of the husband can be made sooner. And the one who, out of ignorance, married someone who was abandoned for a while by her wife, and then was abandoned by him because his former wife returned to him, committed fornication, but out of ignorance, so marriage is not forbidden to her, but it is better if she remains that way. If a warrior, whose wife, due to his long absence, married another man, returns after some time, he, if he wishes, should take his wife back, and forgiveness is given to her and the man who brought her into his house in his second marriage for the sake of ignorance.

Ἡ ἀναχωρήσαντος τοῦ ἀνδρός, καὶ ἀφανοῦς ὄντος, πρὸ τοῦ πεισθῆναι περὶ τοῦ θανάτου αὐτοῦ, ἑτέρῳ συνοικοῦσα, μοιχᾶται. Ὡσαύτως καὶ στρατιώτιδες, αἱ, τῶν ἀνδρῶν ἀφανῶν ὄντων, γαμηθεῖσαι, τῷ αὐτῷ ὑπόκεινται λόγῳ· ὥσπερ καὶ αἱ διὰ τὴν ἀποδημίαν τοῦ ἀνδρὸς μὴ ἀναμείνασαι τὴν ἐπάνοδον.
