Canon 40
That clergy who do not obey their bishop, who wants to elevate them to the highest degrees, are deprived of their existing rank.
Resolved: if any clergy and deacons do not obey their bishops when, due to the forced circumstances of their Churches, they want to elevate them to a higher rank in their Church, then let them not serve in that degree that they did not want to leave.

Ὁμοίως ἤρεσεν, ἵνα οἱοιδήποτε κληρικοὶ καὶ διάκονοι, ἐὰν μὴ πειθαρχῶσι τοῖς ἐπισκόποις αὐτῶν, βουλομένοις διά τινας ἀναγκαστικὰς αἰτίας τῶν ἐκκλησιῶν αὐτῶν τούτους πρὸς μείζονας ἀναβιβάζειν τιμὰς ἐν τῇ ἐκκλησίᾳ αὐτῶν, μηδὲ ἐν ἐκείνῳ τῷ βαθμῷ διακονήσωσιν, ἐξ οὗ ἀναχωρῆσαι οὐκ ἠθέλησαν.[1]
