New bill would protect mothers with surrogacy contracts from forced abortions Rep. Andy Ogles, R-Tennessee, introduced on July 21 a bill designed to protect pregnant mothers who are surrogates from being forced to have abortions.

The ‘‘ Preventing Forced Abortions Act of 2026 ” would prevent federal courts from forcing a woman to have abortion because of a surrogate contract; the act also requires that surrogate mothers still be compensated.

“No woman should ever be forced to murder a child because of a provision buried in a contract,” Ogles said in announcing the measure. “The Preventing Forced Abortions Act ensures that federal courts cannot enforce these coercive clauses or allow intended parents to withhold promised compensation when a surrogate mother chooses life.”

The pro-life advocacy group Susan B. Anthony Pro-Life America expressed support for the bill. Spokeswoman Marilyn Musgrave voiced support for the bill, saying : “Women should never be forced or coerced into having an abortion.”

It's good that the law also deals with compensation so that a woman does not lose money if she chooses life. It always seemed crazy to me that the obligation to have an abortion could even be written into those contracts. I hope it passes because "no woman should be forced to kill a child for a paper" is exactly that.

I agree, Pavel, the compensation is important so that it is not just an empty gesture. Here in Olomouc, I heard from an acquaintance how surrogates fear even basic medical care if something goes wrong. I hope the law passes, because the contract should not burden the conscience.

It is good that the law also protects compensation, so that the woman is not left without money if she chooses to live. In my school, a teacher's relative was a surrogate and told me that there should be no such clause in the contract at all. I hope it will pass.

I agree with Pavel, this story of a forced abortion clause in a contract always seemed completely crazy to me. At least the bill also protects compensation, as Ogles said, so the surrogate doesn't lose everything if she chooses to keep the child. Let's hope it passes, we shouldn't be able to force a woman into this because of a piece of paper.

It is a good idea to protect the compensation, otherwise the woman would have suffered doubly. My neighbor also had a relative who was thinking about surrogacy and read every clause in the contract, especially this one. I hope the law will be passed and such evil clauses will be removed altogether.

Well said Maya that compensation protection is key to avoid double harm. An acquaintance of mine once read such a contract and it seemed terrible that money would be taken to save the child. I hope the law will be passed and there will be no more such clauses at all.
